Consent to the Collection of Personal Information

By accepting these terms, you give Ex Nehilo Pty Ltd (ACN 688 661 430) and any related entities (“we”, “our”, “us”) permission to collect, use and share your personal information in line with our Privacy Policy (as amended from time to time) and this Personal and Electronic Consents document. Our Privacy Policy outlines how you may access or request corrections to the personal information we hold, how you may lodge a complaint if you believe your privacy rights have been breached, and how we will handle and respond to such concerns.

Your Consent to the Handling of Personal Information

 

You acknowledge, agree and authorise the following:

  • We may collect, use and disclose your personal information for the purposes outlined in our Privacy Policy, including but not limited to assessing credit applications, verifying your identity, marketing our services, and improving our products and internal processes.

  • Information you provide will be retained by us for the specific purposes for which it was obtained.

  • You may request access to or correction of the information we hold by contacting us directly.

  • You may opt out of receiving marketing communications from us at any time.

  • We will comply with any mandatory privacy breach notification requirements under the Privacy Act.

  • If you decide not to provide certain personal information, we may be unable to offer you credit or provide some of our services.

  • We may also be legally obligated to collect, use or disclose your personal information under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth). You authorise us to use and disclose your information as necessary for compliance.

You consent to us doing any of the following:

Credit Information

  • Obtain and use personal credit information about you for the purpose of assessing your application for credit.

Landlord / Rental History

  • Request rental history, landlord contact details and confirmation of your tenancy arrangements.

Credit Reporting Bodies

  • Obtain credit reports about you from credit reporting bodies to assist in assessing your suitability for credit.

  • Provide personal or commercial information about you to credit reporting bodies, which may include:

    • identification details

    • details of your credit application and the amount sought

    • confirmation that we are a current credit provider to you

    • notices that payments are overdue or later repaid

    • information about dishonoured cheques

    • information indicating, in our view, that a serious credit infringement may have occurred

    • confirmation when credit with us has been finalised or discharged.

Disclosure to Third Parties

We may disclose your personal information:

  • as required by law,

  • to parties involved in providing credit services to you,

  • to our related entities, service providers, contractors or agents,

  • to potential investors or parties interested in acquiring an interest in our business or assets,

  • to technology providers assisting in processing your application, including providers located overseas.

Bank Statements / Aggregation Services

By granting us access to your online banking through our third-party data aggregation provider:

  • you authorise that provider to retrieve your bank transaction data on our behalf,

  • we may view up to six months of transaction history at the time of your application and ongoing transaction data during the term of your loan,

  • you acknowledge that your bank may prohibit sharing login credentials, and you appoint our third-party provider as your limited agent solely for this purpose.

Identity Verification

We may disclose your personal information to a credit reporting body to help verify your identity.
If you do not want your identity verified this way, please contact us to discuss alternative methods.

Introducers / Referral Partners

We may provide information about your loan—including terms, balances, and repayment conduct—to any referral partner or introducer involved in your application.

Consent to Receive Documents Electronically

 

By providing electronic consent, you agree to receive all communication, notices, disclosures, contract documentation and related information (“Electronic Communication”) through digital channels such as email, SMS, or via a secure portal on our website.

You understand that:

  • We may either make the documents available within your online account for a reasonable period or send them directly to you via email or other electronic means.

  • If information is posted to your online account, we will notify you by email or SMS using your nominated contact details.

  • You are responsible for regularly checking your nominated inbox or log-in area for new communications.

You may withdraw your consent to receive electronic communications at any time by contacting us, provided you supply an alternative delivery method.

Acknowledgement

You acknowledge that:

  • You are not required to give all consents outlined above; however, withholding certain permissions may prevent Ex Nehilo Pty Ltd from assessing your credit application or your suitability as a guarantor.

  • During the credit application process, we may request additional information from you (including by phone), and any such information will be handled in accordance with our Privacy Policy and these consent terms.
